MUSIC SERVICES TERMS AND CONDITIONS

§1. General Provisions

  1. These Regulations (hereinafter referred to as the "Terms and Conditions") define the rules for using the website available at www.browingrecords.com, including the rules for placing orders for music production services.

  2. The owner of the website and the entity providing the services (hereinafter referred to as the "Service Provider") is: Sławomir Czajka, residing at Kwiatowa 6/1, 64-530 Radzyny, Poland, e-mail address: info@browingrecords.com.

  3. The Service Provider operates as an unregistered business activity (in accordance with Art. 5 of the Act of March 6, 2018 – Entrepreneurs' Law).

  4. The Client (hereinafter referred to as the "Client") may be any natural person, legal person, or organizational unit without legal personality who places an order for services offered on the website.

  5. Contact with the Service Provider takes place electronically via the e-mail address indicated in section 2.

§2. Types and Scope of Services

The Service Provider offers the following paid music services (service descriptions form an integral part of the offer):

1. Mastering

  • The Service Provider approaches every mastering job individually, building the entire process from scratch. The team works according to the standards of the given genre to ensure the track sounds professional and competitive.

  • If the mix is prepared correctly, the Service Provider proceeds immediately to mastering. If it requires minor corrections, the Service Provider will clearly inform the Client and indicate the best solution.

  • This is the final stage of production, aimed at finalizing quality enhancement.

2. Mixing

  • The service involves building the process from scratch and adapting it to the character of the track. The Service Provider ensures that every element – from bass and drums to vocals and effects – is properly balanced, clear, and full of detail.

  • During mixing, the Service Provider maintains the highest technical standards: appropriate volume levels, stereo width, instrument separation, and compliance with professional production requirements.

  • If the material is prepared correctly, the Service Provider proceeds to the mix. In the event of minor shortcomings, they will indicate what is worth correcting.

3. Track Arrangement

  • A service directed at tracks requiring expansion. The Service Provider analyzes the project and checks what needs improvement or reinforcement.

  • As part of the service, missing elements are introduced – e.g., additional bass lines, melodies, sound effects, or other details that give the track fullness and character.

  • The goal is to introduce precise changes that will raise the quality of the track and allow it to sound professional.

4. Create Your Track (Song Production)

  • The service involves creating a track from scratch – from inspiration, through arrangement and mixing, to professional mastering.

  • Every element of the track is created manually by producers and sound engineers.

  • NO-AI Clause: The Service Provider does not use artificial intelligence to generate entire tracks. Each project is created in a fully human, unique way, tailored to the Client's vision.

§3. Order Placement and Execution

  1. Ordering a service takes place via the order form available in the online store (adding the service to the cart and confirming the purchase).

  2. The condition for commencing the order is: a) Determining the scope of work (in accordance with the order placed in the Store); b) Delivery by the Client of the necessary materials (audio files) meeting technical requirements; c) Payment for the order in accordance with §4.

  3. Turnaround Time: The service completion deadline is calculated from the moment the Service Provider receives a complete set of correct materials (files) and the payment is credited. The turnaround time is indicated individually in the description of each Service in the Store. In the absence of such information, the standard turnaround time is up to 14 business days.

  4. The Service Provider shall not be held liable for the final quality of the recording if it results from the low quality of source files provided by the Client, and the Client – despite information from the Service Provider – decided to proceed with the service on such materials.

§4. Prices and Payments

  1. The prices of services listed on the website are final prices (gross), expressed in Euros (EUR). Due to the legal status of the Service Provider (natural person not conducting a registered business activity), VAT is not added to the prices.

  2. Payment takes place via external payment operators: Stripe (payment cards, electronic payments) and PayPal.

  3. At the Client's request, the Service Provider issues a bill/receipt confirming the performance of the service.

§5. Revisions (Corrections)

  1. Within the agreed price, the Client has the right to submit comments and corrections (revisions) to the sent material.

  2. The standard number of free revision rounds is: 2 rounds, unless established otherwise through individual arrangements.

  3. All comments should be submitted in the form of a concise list (e.g., via e-mail) within 2 days of receiving the initial version of the track.

§6. Copyrights

  1. In the case of Mixing and Mastering services, the copyright to the composition and lyrics remains with the Client.

  2. In the case of Arrangement and Create Your Track services, upon payment of the full remuneration, the Service Provider transfers the economic copyrights to the created track/arrangement to the Client on the following fields of exploitation: recording, reproduction by any technique, placing on the market, public performance, as well as making available on the Internet (streaming, digital platforms).

  3. The transfer of rights referred to in section 2 takes place without territorial or time limitations.

§7. Withdrawal from the Agreement and Complaints

  1. In accordance with Art. 38 of the Consumer Rights Act, the right to withdraw from a distance contract does not apply to the Consumer in relation to contracts where the subject of the service is a non-prefabricated item, produced according to the consumer's specifications or serving to satisfy their individualized needs (e.g., a mix of a specific track, creation of a custom arrangement).

  2. In the event of objections regarding the quality of the service performed, the Client has the right to file a complaint via e-mail to the Service Provider's address.

  3. The complaint should contain a description of the problem and the Client's expectations. The Service Provider will consider the complaint within 14 days.

§8. Personal Data

  1. The Administrator of the Client's personal data is the Service Provider.

  2. Personal data is processed exclusively for the purpose of order fulfillment, issuing a bill, and contact with the Client. Providing data is voluntary but necessary to perform the service.

§9. Final Provisions

  1. In matters not covered by these Terms and Conditions, the provisions of the Polish Civil Code and the Act on Copyright and Related Rights shall apply.

  2. The Service Provider reserves the right to introduce changes to the Terms and Conditions. For orders placed before the change of the Terms and Conditions, the version in force on the day of placing the order applies.

  3. The Terms and Conditions enter into force on the day of publication on the website.
